
Webcast Group Terms and Conditions
General Policies
1. Credit policy – All Webcast Group Inc. invoices are due upon receipt. Payments received after due date will be charge late fees of 50.00 per billing cycle until payment is received in full. New clients require a 50% up front payment with the remainder due upon completion. Clients who do not pay within 30 days of completion will be placed on pre pay. Late payment fees will apply to all invoices past 30 days. Payments should be made to: Webcast Group, Inc., 20220 Center Ridge Road, Suite 200, Rocky River, OH 44116.
2. Work and functionality – WGI is responsible only for the work detailed in your quote. Any additional work will be subject to additional fees.
Liability and responsibility – WGI is not liable for any losses the client may incur due to problems in the webcast. WGI is not responsible for Internet failures.
3. WGI is not responsible for internet connection speeds at the location of the webcast unless the location is the WGI studio. WGI's sole liability will be, at WGI's discretion, to replace the event with another live event of equal value.
4. Event failure – If an event fails due to circumstances beyond the control of WGI, the client will be responsible for all actual costs incurred by WGI up to the amount of the entire webcast. If an event fails due to fault of WGI then the client may reschedule the event at full cost AND WGI will provide the client with a second webcast of equal or lesser value for free. The free event will not include travel costs or third party contractor costs required to produce the event.
5. Cancellation & Re-scheduling Fees – Webcasts that are cancelled will be charged for any work done up to the point of cancellation with a minimum cancellation fee of $150. Webcasts that are cancelled or rescheduled less than two weeks prior to the event will be charged all travel expenses that have been paid and a 50% event fee. Webcasts that are cancelled or rescheduled less than 7 calendar days prior to the event will be charged travel fees that have been incurred and a 100% cancellation fee.
6. All webcasts are subject to an overage charge if you exceed the contracted amount of viewing.
7. The client agrees to pay for services set forth in this contract. Failure to pay contracted fees will result in legal action. Client agrees to pay any and all legal costs incurred by Webcast Group, Inc. in an effort to collect debt.
Acceptable Use Content Policy
1. You may not transmit through the webcast, any information, data, text, images, files, links, software, chat, communication or other materials ("Content") that is, or which Webcast Group considers in its sole discretion to be, unlawful, threatening, abusive, harassing, libelous, defamatory, obscene, pornographic, harmful or which contains blatant expressions of prejudice, hatred, excessive profanity or excessive violence;
2. Invade the privacy, publicity or civil rights of any person or entity;
3. Post or disclose any personally identifying information or private information about children or any third parties without their consent (or their parents’ consent in case of a child under 18 years of age);
4. Sell or promote any products or services that are unlawful in the location at which the content is posted or received;
5. Introduce viruses, worms, Trojan horses and/or harmful code on the Internet;
6. Impersonate any other person, including but not limited to, a Webcast Group official, expert, guide or host; and
7. Post any Content that would infringe or misappropriate in any way or violate any copyright, patent, trademark, service mark, trade name, trade secret or other intellectual property right of any third party. WGI is NOT responsible for clients using trademarked content without prior legal permission.
